  13. this software indicates your acceptance of these
  14. terms and conditions.  If you do not agree with

  18. SHAREWARE VERSION LICENSE

  20. The Shareware Version is not free software.  If
  21. you are using the Shareware Version you are
  22. hereby licensed to use this software for
  23. evaluation purposes without charge for a period
  24. of 50 uses.  If you use this software after the
  25. 50-use evaluation period a registration fee is
  26. due (see Ordering Information).

  28. If you are using the Shareware Version of the
  29. software you are also hereby licensed to: Make as
  30. many copies of the Shareware version of this
  31. software and documentation as you wish; Give
  32. exact copies of the original Shareware version to
  33. anyone; Distribute the Shareware version of the
  34. software and documentation in its unmodified form
  35. via electronic means.  There is no charge for any
  36. of the above.

  39. 50-use evaluation period is in violation of
  40. federal copyright laws.

  43. engineer, or modify any version of File Merge
  44. Express (shareware) in any manner.

  47. REGISTERED VERSION LICENSE

  49. One registered copy of File Merge Express may be
  50. dedicated to a single person who uses the
  51. software on one or more computers or workstations
  52. that are for their own exclusive use and for
  53. which they are the sole user.

  55. The purchase of a single user license
  56. specifically does not permit use of the program
  57. to modify, update, or search multiple
  58. workstations, directly or indirectly, via any
  59. means.  A single user license may not be made
  60. available in any form to multiple users or
  61. workstations.

  63. Licensing is not based on "concurrent" users.  If
  64. multiple workstations are to access the program
  65. in any form and for any length of time you must
  66. purchase licenses for the number of workstations
  67. that will access the program.  If you make the
  68. registered version of File Merge Express
  69. available through a network and accessible by
  70. multiple users or workstations you are required
  71. to purchase licenses for the software covering
  72. all workstations that will access the software
  73. through the network.  Special pricing is
  74. available for multiple licenses.  See Ordering
  75. Information for information on how to purchase
  76. (register).

  83. WORKSTATION UPDATE AND/OR SPECIAL USE LICENSE

  85. Special licensing (and pricing) is available for
  86. modifying or searching multiple workstations,
  87. directly, or indirectly via scripts, command line
  88. processing, or logon routines.  The purchase of a
  89. special use license allows you to use the program
  90. to update the number of workstations for which
  91. you purchased special use licenses for.  Unless
  92. otherwise noted at the time of your purchase, a
  93. workstation update/special use license
  94. specifically does not allow individual
  95. workstation users to access the program for
  96. interactive use.  Do not create desktop shortcuts
  97. or launchers that allow workstation users to
  98. access the program outside of the specific update
  99. routine for which you purchased the special use
  100. license.

  108. OWNERSHIP RIGHTS

  111. copyrights, patents, trade secret rights,
  112. trademarks and intellectual property rights to
  113. this software. Registration &/or use of the
  114. software does not grant you any right to the
  115. intellectual property in the product.

  125. RESTRICTIONS

  127. You are prohibited by law from selling, renting,
  128. leasing, loaning, or donating the program or
  129. documentation in whole or in part without
  130. specific advance agreement between yourself and
  131. Funduc Software, Inc.  You are prohibited by law
  132. from redistributing the registered version of the
  133. program by any method or in any form except to
  134. the specific individuals for whom the software
  135. was purchased.  You are prohibited from
  136. decompiling, reverse engineering, disassembling,
  137. or otherwise reducing the program to human
  138. readable form for any purposes whatsoever.  You
  139. may not modify the program or documentation in
  140. any manner.  You are prohibited from permitting
  141. anyone else from undertaking any of the above
  142. actions.

  145. reverse engineer File Merge Express (registered
  146. or shareware) in any manner.

  149. GOVERNING LAW

  151. This agreement shall be governed by the laws of
  152. the State of Michigan.

  155. DISCLAIMER OF WARRANTY

  157. This software and the accompanying files are sold
  158. "as is" and without warranties as to performance
  159. of merchantability or any other warranties
  160. whether expressed or implied.  In particular,
  161. there is no warranty for the string Replacing
  162. feature.
  163.  
  164. Good data processing procedure dictates that any
  165. program be thoroughly tested with non-critical
  166. data before relying on it. The user must assume
  167. the entire risk of using the program. Any
  168. liability of the seller will be limited
  169. exclusively to product replacement or refund of
  170. purchase price.
